David H. Weinstein
weinstein@wka-law.com

Mr. Weinstein is the Firm’s senior partner. He has extensive experience litigating complex commercial matters. Since 1972, he has represented clients charging some of the nation’s largest companies with violating the securities, antitrust, consumer protection and R.I.C.O. laws.

Mr. Weinstein successfully prosecuted a class action for homeowners nationwide whose homes contained defective polybutylene plumbing. As co-lead counsel in the case, Mr. Weinstein achieved an innovative settlement that has provided over $990 million in class relief, one of the largest property damage class action settlements in history. He served on the steering committee of attorneys who recovered over $700 million for retail pharmacies in a class action charging major manufacturers and wholesalers of brand name prescription drugs with conspiring not to offer discounts to retail pharmacies. Mr. Weinstein is currently lead counsel in an employment class action and an antitrust class action.

Outside the courtroom, Mr. Weinstein has served on the board of directors of the Trial Lawyers for Public Justice Foundation, a national public interest legal foundation that strives to protect the liberties and rights of individuals often victimized in our society. He has served as co-chair of the Professional Guidance Committee of the Philadelphia Bar Association, and he is an elected member of the American Law Institute, a national professional society dedicated to the simplification and improvement of American law. Mr. Weinstein is a member of the Committee to Save the Antitrust Laws and has presented lectures on various topics in educational courses for practicing lawyers.

Mr. Weinstein earned his undergraduate and law degrees from the University of California, Berkeley. Before entering private practice, he served as law clerk for two different judges of the United States Court of Appeals for the Ninth Circuit. He is a member of the Pennsylvania and California bars, and has been admitted to practice before the U.S. Supreme Court, and various federal district courts and courts of appeals.

Robert S. Kitchenoff
kitchenoff@wka-law.com

Mr. Kitchenoff concentrates his practice in the prosecution of consumer fraud, antitrust, securities fraud, and ERISA class actions as well as whistleblower, shareholder derivative, and other complex civil matters. Mr. Kitchenoff’s experience in such matters includes the successful representation of a class of homeowners who were led to believe, by the builder of their homes, that they were receiving "thermal break" windows that were "as good as an Andersen." The case settled, with class members offered the option of having all their windows replaced with a true thermal break window or receiving the cash value of such replacement.

Mr. Kitchenoff has successfully prosecuted numerous securities fraud class actions. In one such case, shareholders had been deceived by claims of a movie production company that touted itself as the next Disney, comparing the potential profitability of its sole animated film with many of the all-time Disney classics. This scheme allowed insiders to sell most of their shares at grossly inflated prices before the film opened to small audiences and negative reviews. The SEC has since barred the president of the company from any future involvement in publicly traded companies.

Currently, Mr. Kitchenoff is involved in the prosecution of antitrust and consumer fraud class actions in numerous industries.

Mr. Kitchenoff earned his bachelor's degree from the University of Pittsburgh, and his law degree from Rutgers University School of Law. He served as law clerk for the Honorable Madaline Palladino of the Commonwealth Court of Pennsylvania. He currently serves on the Editorial Board of the Class Action Law Monitor, and is a member of the CyPres Committee of the Philadelphia Bar Association. He has been a course planner and faculty member on class action issues for the Philadelphia Bar Association. He is a member of the Pennsylvania and New Jersey bars, and has been admitted to practice before the U.S. Supreme Court, U.S. Court of Appeals for the Third Circuit and several district courts.
